Old Lyme Board of Selectmen
Regular Meeting Monday, June 6, 2005 APPROVED

The Board of Selectmen held a regular meeting at 9:00 A.M. on Monday, June 6, 2005 at Memorial town Hall Auditorium.  First Selectman Timothy Griswold, Selectman Skip Sibley and Selectwoman Bonnie Reemsnyder were present.

Approval of Minutes:  May 16, 2005 (Special) and May 16, 2005 (Regular)                 
Selectwoman Reemsnyder made a motion to approve the minutes of the executive session held on May 16, 2005.  Selectman Sibley seconded the motion.  SO VOTED.
Selectwoman Reemsnyder made a motion to approve the minutes of the regular meeting on Monday, May 16, 2005.  Selectman Sibley seconded the motion.  SO VOTED.

Communication:
a.   Gov. Rell – Signed Bill to Protect the Eight Mile River Watershed
Gov. M. Jodi Rell signed legislation to protect and preserve the Eight Mile River watershed in Lyme.  The 62-square mile area consists of more than 160 miles of rivers and streams.

b.   CT Dept of Public Safety –CMED Credit to Valley Shore Communications
The Board of Selectmen agreed to designate Valley Shore Communications as the recipient of CMED.  The credit amount is based on the Old Lyme population of 7,483 times 15 cents for a total of  $1,122.45.  A senate bill is in the works that proposes to raise the existing credit from 15 cents to 30 cents and so, if it passes, it will double the value of the credit.

c.   CT Fund for the Environment – Sound Alliance NO to Broadwater Sound Alliance No To Broadwater is a group that opposes a liquefied natural gas industrial terminal in the middle of Long Island Sound.  The vessel that would come to the terminal is ten stories tall, 1200 feet long, 180 feet wide.  If permitted, this project would increase the number of large ships traversing Long Island Sound by approximately two to three tankers per week for the entire life of the broadwater project.  The group is asking various towns to oppose this proposal and is requesting letters be sent to those who approve the proposal.  First Selectman Griswold will contact Rep. Marilyn Giuliano for her input.      

d.  The Historic District Commission – Letter to Property Owners The Historic District Commission sent letters to property owners on Lyme Street.  This spring, the Historic District Commission will take exterior photographs, front and side elevations only, of all properties in the district to be added to the Historic Commission’s existing file to serve as the 2005 base line for the district.

e.  Laurence Urdang – Lyme Street Project                                                                      First Selectman Griswold received a note from resident Larry Urdang who commended the Board of Selectmen for their effort, time, talent and efficiency on the excellent job
of improving the appearance of Lyme Street.

Appointments:
a.  Lymes Senior Center – Linda Winzer (R) 3-Yr. Term to July 2006
Linda Winzer, who recently moved to Old Lyme, is seeking to fill an expired term on the Lymes Senior Center Board. Selectwoman Reemsnyder made a motion to approve Linda Winzer to the three-year term ending July 2006 on the Lymes Senior Center Board.  Selectman Sibley seconded the motion.  SO VOTED.

b.  Open Space Committee – Amanda Blair (D) – 1 Yr Term to January 2006                
Selectwoman Reemsnyder made a motion to approve Amanda Blair to the one-year term ending January 2006 to the Open Space Committee.   Selectman Sibley seconded the motion.  SO VOTED.

c.  Resignation – Commission on Aging – Diane Simpson                                          Diane Simpson has resigned from the Commission on Aging because of time constraints.  

Old Business:  
a.  ARIA, LLC – Open Space Proposal for 40 Acres
Since Planning is not in favor of the purchase of 40 acres of land from ARIA, LLC at $10,000 per acre for open space, the Board of Finance did not take a vote on it.  First Selectman Griswold explained to the developer that there is a split opinion in town within the boards and commissions and, even though Old Lyme is still looking at the proposal,
he released ARIA LLC from any perceived obligation.  First Selectman Griswold has
requested the attorney for Land Use, Atty. Jim Mattern, to provide a more thorough outline with the steps in sequence as to the possible acquisition of the land.

b.  Abandonment of a Portion of Ben Franklin Road - Status
A meeting will be scheduled with Town Historian Ned Pfeiffer, landowner David Dangramond, Atty. Marylin Clarke and First Selectman Griswold to explore putting an historic designation to the Ben Franklin Road area to protect it.  Selectman Sibley suggested talking with the Historic Commission, but First Selectman Griswold said this matter is not within its jurisdiction.

c.  Lyme Street Reconstruction Project - Update
Sidewalk improvements in the Library Lane/ Ice Cream Shop area as well as the Lyme Youth Service Bureau area will be next on the Lyme Street project agenda. Sidewalks will be done on Halls Road when a second estimate is received.  Selectwoman Reemsnyder suggested asking the police to put the speed machine on Lyme Street.  

d.  Town Woods Field House – Ribbon Cutting – 11:00 A.M. June 18, 2005               A ribbon cutting ceremony has been scheduled for June 18, 2005 at 11:00 A.M. State Senators and Representatives will be among the invited guests.  A flag pole dedication ceremony will be part of the ceremony.





e.   Sound View Village District - Update
Selectman Sibley reported there will be a public hearing on Monday, June 27 at 7:30 P.M. at the Middle School.  

f.   Jadon Drive Bus Barn - Discussion
The school buses use approximately 41,000 gallons of fuel a year and the price differential between standard fuel and ultra low sulfur diesel could vary from 8 cents to 30 cents. Using a price of 27.5 cents/gallon, the low sulfur fuel would cost $11,275 more.  If the town worked in conjunction with the school to meet the minimum delivery of fuel, it could lower the price. The fuel could be used between the school, fire dept, and ambulance.  The oxidation catalyst might run $1,000 to $1,200 per bus. The particulate filter that reduces diesel pollution 90 to 95 percent would cost about $10,000 per bus.  First Selectman Griswold spoke about possible EPA grants.

5.   New Business:
CT Dept of Public Safety – Resident Trooper Contract
First Selectman Griswold presented to the Board of Selectmen a two-year contract for the Resident State Trooper service from July 1, 2005 to June 30, 2007.  The contract between the Town of Old Lyme and the Connecticut State Police is to satisfy the legal requirements.  A resolution is necessary empowering the First Selectman to sign a contract on behalf of the town and the Town Clerk must certify the resolution.  Selectman Sibley made a motion to authorize First Selectman Griswold to execute the contract for two years with the Connecticut State Police.  Selectwoman Reemsnyder seconded the motion.   SO VOTED.

Estuary Council of Seniors – Senior Center Groundbreaking
A groundbreaking ceremony took place at the Estuary Senior Center in Old Saybrook.

Town Forum – Establish Date (June 22 or 29)
A Town Forum will take place on Wednesday, June 29, 2005 at 7:30 P.M. at the Middle School Auditorium.

Wood Crest Estates Subdivision – Road Design Modification
Kevin Kenny spoke about Wood Crest Estates subdivision located to the north of Point O’Woods. He plans to construct a 900-ft. road ending in a cul-de-sac to serve 11 houses.  He intends the road will become a town road. A shared driveway will serve lots 1 through 4.  Another shared driveway will serve lots 7, 9, 10, and 11.  Three lots have individual driveways. The Wetlands Commission requested to have as much sheet flow as possible versus point discharge with a storm drainage system with no curbing on the easterly side.  A waiver was required and approved by the Planning Commission. Mr. Kenny is seeking
a waiver by the Board of Selectmen of the road standards on curbing as cited in the subdivision regulations. Mr. Kenny is also seeking approval of the design of the road and concurrence of the approval he has from the Wetlands and Planning Commissions.  The final item is bond approval. First Selectman Griswold read a resolution that he and Ann Brown prepared in compliance with the code of the Town of Old Lyme. Selectwoman Reemsnyder made a motion to approve the resolution through number three. Selectman Sibley seconded the motion.  SO VOTED.  The discussion on the bond amount has been tabled to the next Board of Selectmen meeting.    

LOLHS Student Leaders Gratitude Dinner
First Selectman Griswold and Selectwoman Reemsnyder attended the sixth annual Student Leaders Gratitude Dinner.  The students are involved in a recycling effort in the high school among other activities.  The students meet before school and are active and dedicated to their projects.

Old Lyme Rowing Assoc. – Request to Use Town Truck
The Old Lyme Rowing Association has requested the use of a town truck to tow the racing shells to various places.  Selectman Sibley made a motion that the Board of Selectmen grants the Old Lyme Rowing Association permission to use the town truck starting June 6, 2005 through the 2005 rowing season as requested in the Association letter of May 12, 2005.  Selectwoman Reemsnyder seconded the motion.  SO VOTED.

Public Comment:

Other Business:
Ann Brown of Inland-Wetlands spoke about creating an ordinance concerning writing citations for fines for violations of the Old Lyme Inland-Wetlands and Watercourses regulations. She stated that statutes enable town to enact such an ordinance so that wetlands violators can be given a ticket right on the spot with a fine attached.  The range of the fines is $250 to $1,000. The Wetlands Commission would need to make a guideline to be used as a tool to promote compliance with the regulations.  An appeals process must be set in place. Attorney Clarke has been notified.

Selectman Sibley made a motion that the Board of Selectmen recommends that Dr. Awwa construct the proposed cul-de-sac to town standards so that will become part of the town road known as Lord’s Woods and the Board does not accept the road extension beyond the cul-de-sac as an unapproved town road.  Selectwoman Reemsnyder seconded the motion.  SO VOTED.

Selectman Sibley reported that resident Bert Dean has a ponding situation on Hillside Road.
Rogers Lake Authority will meet on Saturday, June 25, 2005 at noon at the Rogers Lake Community Center regarding hydro raking.
Discussion at the Board of Finance meeting was about the Rogers Lake Dam.  First Selectman Griswold will speak with Jacobson Engineering Company about getting quotes from other engineers.

Selectwoman Reemsnyder made a motion to adjourn the meeting at 11:07 A.M.  Selectman Sibley seconded the motion.  SO VOTED.
